Weekly Working Hours
Regular working hours are limited to maximum of 40 hours per week. compensated for working overtime with equivalent paid time off at their normal rate of pay in the 90 days after the overtime is performed. If it is not possible to grant this paid time off within 90 days, the employee may instead be compensated with a premium rate of pay for the overtime hours worked. The premium to be paid on top of normal wages for the overtime hours is set by an applicable collective agreement or the employment contract and must be at least 75% of the employee's basic pay.

Minimum Wage Requirements
The Minimum wage is established by government decision annually. Different minimum wages can be established for certain employees or for certain industries. An employee can receive the minimum wage for a period of maximum 2 years under the same employment contract. As of January 1, 2025, the minimum wage is RON 4,050 per month and RON 24.50 per hour.
Medical Benefits
Employees are entitled to receive sickness benefit corresponding to 75% or 100% or regular salary, depending on the cause of incapacity, for the first five days paid by the employer. It is then paid by the
social security system for up to 183 days per year.
Probationary Periods
For indefinite term contracts, the probationary period is up to 90 days for standard position and 120 days for managerial positions. For disabled person, up to 30 days. Under fixed term contract, the length of the probation will depend on the length of the contract.
Termination Notice
Length of notice periods depends on the reason for termination.
Under labour leasing, a 20-day only notice period needs to be observed. Additionally, should the employee be the one to give notice, they are required to give notice of 20 days for normal positions and 45 days for managerial positions to the employer.
Severance
There are no legal provisions on the employer needing to provide severance pay to dismissed employees, apart from the dismissal for physical and/or psychological unfitness, when the employer needs to offer the dismissed employee compensation. The labour code does not provide any amount. Specific amounts may be provided by collective bargaining agreements if any.
