Bien que la loi f\u00e9d\u00e9rale sous-jacente n\u2019ait pas chang\u00e9, l\u2019ICE a mis de c\u00f4t\u00e9 des d\u00e9cennies de directives ant\u00e9rieures et consid\u00e8re maintenant de nombreuses erreurs courantes de l\u2019I-9 comme des violations substantielles soumises \u00e0 des sanctions imm\u00e9diates et sans p\u00e9riode de correction. <strong> <\/strong><\/p>\n\n<p class=\"has-small-font-size\"><\/p>\n\n<h3 class=\"wp-block-heading\">Qu\u2019est-ce qui a chang\u00e9<\/h3>\n\n<p>En mars 2026, l\u2019ICE a mis \u00e0 jour ses directives d\u2019inspection du formulaire I-9 de longue date en reclassant de nombreuses erreurs historiquement consid\u00e9r\u00e9es comme techniques ou proc\u00e9durales en violations substantielles. Les infractions substantielles ne sont pas admissibles \u00e0 la p\u00e9riode de correction de 10 jours ouvrables et peuvent entra\u00eener des p\u00e9nalit\u00e9s p\u00e9cuniaires imm\u00e9diates contre les employeurs si elles sont identifi\u00e9es lors d\u2019une inspection. <\/p>\n\n<p>Cette directive s\u2019\u00e9carte de d\u00e9cennies de pratiques d\u2019application qui permettaient aux employeurs de corriger certaines lacunes de l\u2019I-9 apr\u00e8s avoir re\u00e7u un avis d\u2019inspection (NOI). L\u2019ICE a chang\u00e9 son interpr\u00e9tation et sa posture d\u2019application, et non les exigences l\u00e9gislatives elles-m\u00eames.   <\/p>\n\n<h3 class=\"wp-block-heading\">Ce que la loi dit encore<\/h3>\n\n<p>Selon la Loi <a href=\"https:\/\/www.uscis.gov\/laws-and-policy\/legislation\/immigration-and-nationality-act\">sur l\u2019immigration et la nationalit\u00e9<\/a><a href=\"https:\/\/www.uscis.gov\/laws-and-policy\/legislation\/immigration-and-nationality-act\" target=\"_blank\" rel=\"noreferrer noopener\">(INA)<\/a> \u00a7 274A :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Les employeurs peuvent corriger des erreurs <em>techniques ou proc\u00e9durales<\/em> du formulaire I-9 dans les 10 jours ouvrables suivant l\u2019avis.<\/li>\n\n\n\n<li><em>Les violations substantielles<\/em> ne sont pas corrigibles et peuvent entra\u00eener des sanctions civiles.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Exemples d\u2019erreurs d\u00e9sormais trait\u00e9es comme substantielles<\/h3>\n\n<p>Selon les directives r\u00e9vis\u00e9es, l\u2019ICE peut imposer des p\u00e9nalit\u00e9s pour les erreurs, y compris, mais sans s\u2019y limiter :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Date de naissance de l\u2019employ\u00e9 manquant dans la Section 1<\/li>\n\n\n\n<li>Date de signature manquante de l\u2019employ\u00e9 dans la Section 1<\/li>\n\n\n\n<li>Date d\u2019embauche manquante dans la Section 2<\/li>\n\n\n\n<li>Nom ou titre de repr\u00e9sentant employeur manquant ou incomplet<\/li>\n\n\n\n<li>Informations manquantes ou incorrectement enregistr\u00e9es sur les documents de la liste A, B ou C<\/li>\n\n\n\n<li>Utilisation du formulaire I-9 en espagnol \u00e0 l\u2019ext\u00e9rieur de Porto Rico<\/li>\n\n\n\n<li>Informations incompl\u00e8tes sur le pr\u00e9parateur\/traducteur (Suppl\u00e9ment A)<\/li>\n\n\n\n<li>Date de r\u00e9embauche manquante (Suppl\u00e9ment B)<\/li>\n\n\n\n<li>Erreurs li\u00e9es \u00e0 la v\u00e9rification \u00e0 distance, y compris l\u2019absence de participation ad\u00e9quate \u00e0 E-Verify lors de l\u2019utilisation de la proc\u00e9dure alternative<\/li>\n<\/ul>\n\n<p>Il est \u00e0 noter que conserver des photocopies de documents ne corrige pas les champs de formulaire manquants ou incomplets, m\u00eame si les copies sont claires et lisibles.
