La v\u00e9rit\u00e9 est qu\u2019il existe de nombreuses agences f\u00e9d\u00e9rales et \u00e9tatiques qui s\u2019int\u00e9ressent beaucoup \u00e0 la classification ad\u00e9quate des travailleurs afin de leur offrir les avantages et protections auxquels ils auraient droit en tant qu\u2019employ\u00e9s. Quelques exemples d\u2019organismes gouvernementaux et de lois qui d\u00e9pendent de la classification des travailleurs incluent l\u2019IRS, les agences fiscales d\u2019\u00c9tat, la FLSA, le DOL, les bureaux d\u2019assurance-emploi d\u2019\u00c9tat, l\u2019indemnisation des travailleurs, l\u2019EEOC et Obamacare.  <\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Dans un exemple r\u00e9cent de cette dynamique, un chauffeur que le service de covoiturage Uber avait class\u00e9 comme travailleur autonome s\u2019est vu accorder des prestations de ch\u00f4mage apr\u00e8s la fin de leur relation par l\u2019entreprise. Le d\u00e9partement californien du d\u00e9veloppement de l\u2019emploi (EDD) a accord\u00e9 au conducteur jusqu\u2019\u00e0 9 308 $ en assurance-ch\u00f4mage. Cette d\u00e9cision signifie que l\u2019EDD consid\u00e8re le chauffeur comme un employ\u00e9 d\u2019Uber, puisque les travailleurs autonomes ne sont pas admissibles \u00e0 l\u2019aide au ch\u00f4mage.    <\/span><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Ce d\u00e9veloppement ajoute certainement une nouvelle complexit\u00e9 \u00e0 la lutte continue d\u2019Uber pour savoir si ses chauffeurs sont des employ\u00e9s ou des travailleurs ind\u00e9pendants. Mais cela illustre aussi que la mauvaise classification des travailleurs n\u2019est pas seulement une question d\u2019imp\u00f4t sur le revenu. La pression pour Uber est de classer ses chauffeurs comme des employ\u00e9s et de leur accorder des avantages sociaux tels que le paiement des heures suppl\u00e9mentaires et le remboursement des frais de conduite, en plus de verser des cotisations de ch\u00f4mage et d\u2019indemnisation des travailleurs au nom des travailleurs.    <\/span><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Bien que cette d\u00e9cision n\u2019affecte directement qu\u2019un seul chauffeur concern\u00e9 et n\u2019\u00e9tablisse pas de norme juridique contraignante, elle pourrait certainement avoir un impact sur la question plus large de savoir si tous les chauffeurs Uber sont des employ\u00e9s ou des travailleurs ind\u00e9pendants. Uber doit compara\u00eetre en proc\u00e8s cet \u00e9t\u00e9 devant un tribunal f\u00e9d\u00e9ral de San Francisco pour contester un recours collectif intent\u00e9 par des chauffeurs californiens qui souhaitent \u00eatre class\u00e9s comme employ\u00e9s. Une d\u00e9cision contre Uber pourrait avoir un impact majeur sur l\u2019ensemble de son mod\u00e8le d\u2019affaires, et pourrait aussi causer des probl\u00e8mes \u00e0 de nombreuses autres startups \u00e0 la demande qui d\u00e9pendent de travailleurs ind\u00e9pendants pour fournir des services \u00e0 leurs clients.  <\/span><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Pour traiter la r\u00e9clamation du chauffeur, l\u2019EDD a envoy\u00e9 un questionnaire de neuf pages contenant 100 questions d\u00e9taill\u00e9es sp\u00e9cifiquement destin\u00e9es aux chauffeurs Uber. Les questions portaient sur une multitude de sujets li\u00e9s \u00e0 la relation de travail du chauffeur avec l\u2019entreprise, portant sur les v\u00e9rifications des ant\u00e9c\u00e9dents, l\u2019inspection du v\u00e9hicule, les exigences du programme de formation et les retours de performance d\u2019Uber. <\/span><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Cette allocation de ch\u00f4mage est conforme \u00e0 une autre d\u00e9cision rendue l\u2019an dernier par le bureau du commissaire du travail de la Californie, qui a conclu qu\u2019un autre chauffeur Uber \u00e9tait un employ\u00e9 et avait droit aux avantages sociaux. Mais une d\u00e9cision de 2012 du m\u00eame bureau a conclu qu\u2019un autre conducteur \u00e9tait un travailleur autonome. En fait, les d\u00e9partements du travail dans 13 \u00c9tats, dont l\u2019Arizona, la Floride, New York et la Virginie \u2014 ainsi que l\u2019EDD en Californie \u2014 ont constat\u00e9 que les conducteurs individuels sont des travailleurs autonomes.  <\/span><\/p>\n<p><span style=\"color: #000000;font-family: Calibri\">Ces d\u00e9cisions contradictoires illustrent la complexit\u00e9 de la question employ\u00e9 versus contractant autonome. La question est encore plus compliqu\u00e9e par le fait qu\u2019un large \u00e9ventail d\u2019agences f\u00e9d\u00e9rales et \u00e9tatiques se pr\u00e9occupent de la classification des travailleurs.
