Alors que nous revenons de la pause des F\u00eates et que nous plongeons dans 2016, c\u2019est un bon moment pour examiner les risques potentiels de mauvaise classification des travailleurs et discuter de strat\u00e9gies efficaces d\u2019att\u00e9nuation des risques. <\/p>\n<p><!--more--><\/p>\n<p>Les dirigeants d\u2019entreprise en ressources humaines, juridique et approvisionnement reconna\u00eetront que ces publications gouvernementales servent aussi efficacement de pr\u00e9visions des tendances d\u2019application par les agences gouvernementales qui les publient. En cons\u00e9quence, les dirigeants strat\u00e9giques se pr\u00e9pareront en cons\u00e9quence afin de r\u00e9duire les risques juridiques potentiellement importants. <\/p>\n<p><strong>Le risque d\u2019une mauvaise classification des travailleurs<\/strong><\/p>\n<p>Le DOL et l\u2019IRS se concentrent tous deux sur l\u2019une des erreurs les plus courantes commises par les entreprises \u2013 la mauvaise classification d\u2019un travailleur comme travailleur autonome, alors qu\u2019en r\u00e9alit\u00e9 cette personne devrait \u00eatre correctement class\u00e9e comme employ\u00e9.<\/p>\n<p>Le probl\u00e8me de la mauvaise classification des travailleurs touche les employeurs de toutes tailles \u2013 des plus petites entreprises locales aux soci\u00e9t\u00e9s mondiales cot\u00e9es en bourse. C\u2019est aussi sans doute l\u2019une des erreurs les plus co\u00fbteuses en droit du travail qu\u2019une entreprise puisse commettre, car sa port\u00e9e peut rapidement prendre de l\u2019ampleur. Ne pas classifier correctement un travailleur peut entra\u00eener le paiement de la m\u00eame erreur sur plusieurs fronts :  <\/p>\n<ul>\n<li><strong>Imp\u00f4ts, int\u00e9r\u00eats et p\u00e9nalit\u00e9s<\/strong> : Premi\u00e8rement, d\u2019un point de vue fiscal, l\u2019employeur sera responsable devant l\u2019IRS de certains imp\u00f4ts d\u2019emploi impay\u00e9s, ainsi que des int\u00e9r\u00eats et p\u00e9nalit\u00e9s.<\/li>\n<li><strong>Exposition \u00e0 d\u2019autres agences, lois et r\u00e8glements<\/strong> : Ind\u00e9pendamment de l\u2019IRS, diverses autres agences f\u00e9d\u00e9rales et \u00e9tatiques peuvent intenter des actions en application contre l\u2019employeur. Par exemple, en vertu de la Loi sur les normes de travail \u00e9quitables, le DOL pourrait all\u00e9guer qu\u2019en classant \u00e0 tort ses travailleurs comme travailleurs ind\u00e9pendants, l\u2019employeur a pu refuser \u00e0 ses employ\u00e9s des protections importantes en milieu de travail telles que le salaire minimum et la r\u00e9mun\u00e9ration des heures suppl\u00e9mentaires. Pour att\u00e9nuer cela, le DOL a lanc\u00e9 une \u00ab Initiative de mauvaise classification \u00bb compl\u00e8te qui vise \u00e0 coordonner les efforts concernant le partage d\u2019informations et l\u2019application de ces questions entre les agences f\u00e9d\u00e9rales (<em>par exemple,<\/em> l\u2019Employee Benefits Security Administration, l\u2019OSHA, le Bureau des programmes de conformit\u00e9 des contrats f\u00e9d\u00e9raux et le Bureau du solliciteur). Le DOL a actuellement sign\u00e9 des protocoles d\u2019entente (MOU) de partage d\u2019informations avec 27 \u00c9tats. Par cons\u00e9quent, une simple et souvent innocente mauvaise classification pourrait exposer un employeur involontaire \u00e0 la responsabilit\u00e9 des violations des lois concernant les cong\u00e9s familiaux et m\u00e9dicaux, l\u2019assurance-ch\u00f4mage, l\u2019indemnisation des travailleurs, la s\u00e9curit\u00e9 au travail, les avantages sociaux et\/ou la v\u00e9rification d\u2019emploi. Les cons\u00e9quences pour un employeur qui classe mal les travailleurs peuvent ensuite entra\u00eener des enqu\u00eates et des sanctions de la part de nombreuses autres agences f\u00e9d\u00e9rales et \u00e9tatiques.     <\/li>\n<li><strong>Recours collectif<\/strong> : Le fait de ne pas classer correctement les employ\u00e9s peut m\u00eame entra\u00eener un recours collectif de la part des travailleurs eux-m\u00eames. \u00c0 titre d\u2019exemple seulement, \u00e0 la suite d\u2019une d\u00e9cision du neuvi\u00e8me circuit de 2014 selon laquelle FedEx avait mal class\u00e9 ses chauffeurs comme travailleurs ind\u00e9pendants, les m\u00e9dias ont rapport\u00e9 des discussions concernant un r\u00e8glement de 228 millions de dollars entre la compagnie et une cat\u00e9gorie de ses chauffeurs. <\/li>\n<\/ul>\n<p><strong>Conclusion  <\/strong><\/p>\n<p>Il est toujours recommand\u00e9 pour chaque organisation et son \u00e9quipe de direction de s\u2019assurer que l\u2019entreprise respecte pleinement toutes les r\u00e8gles et r\u00e8glements applicables entourant la classification des travailleurs. La bonne nouvelle, c\u2019est que les entreprises peuvent \u00eatre proactives plut\u00f4t que r\u00e9actives en mati\u00e8re de conformit\u00e9. Par exemple, une entreprise peut engager un expert en conformit\u00e9 et engagement aupr\u00e8s d\u2019un entrepreneur ind\u00e9pendant, comme <g id=\"gid_0\">TalentWave<\/g>, pour confirmer que l\u2019entreprise r\u00e9duit les risques et tire le maximum de la valeur des travailleurs ind\u00e9pendants.
