Dans notre r\u00f4le de sp\u00e9cialistes de la conformit\u00e9 et de l\u2019engagement des entrepreneurs ind\u00e9pendants, les clients des entreprises nous demandent souvent de les aider \u00e0 g\u00e9rer les risques entourant les fournisseurs de services professionnels qui effectuent des travaux sur une base de SOW au b\u00e9n\u00e9fice de l\u2019entreprise cliente. <\/p>\n<p><!--more--><\/p>\n<p>Dans l\u2019article d\u2019aujourd\u2019hui, nous examinerons un ph\u00e9nom\u00e8ne courant dans les programmes d\u2019entreprise : le travailleur individuel qui \u00ab sort de l\u2019ext\u00e9rieur \u00bb de sa propre entreprise (ou de celle pour laquelle il\/elle travaille) et effectue plut\u00f4t un travail en tant qu\u2019employ\u00e9 de fait pour une autre entreprise.<\/p>\n<p>Comment cela fonctionne-t-il? Jetons un coup d\u2019\u0153il&#8230; <\/p>\n<p>Il faut voir \u00e7a comme un auditeur gouvernemental le ferait. Commencez par passer en revue tous les facteurs de common law pour avoir une vue d\u2019ensemble de la relation de travail entre le travailleur et l\u2019entreprise. Un point de r\u00e9f\u00e9rence utile est de vous demander : \u00ab Avons-nous engag\u00e9 une entreprise ind\u00e9pendante (soci\u00e9t\u00e9), ou avons-nous engag\u00e9 une personne pour effectuer le travail?  <\/p>\n<p><strong>Meilleures pratiques<\/strong><\/p>\n<p>Il est important que vous contractiez avec la soci\u00e9t\u00e9 pour effectuer le travail, et non pour une personne qui poss\u00e8de une soci\u00e9t\u00e9 ou travaille pour celle-ci.<\/p>\n<p>C\u2019est une distinction tr\u00e8s importante.<\/p>\n<p>Si vous engagez une entreprise pour effectuer le travail, vous engagez certains sp\u00e9cifiques, livrables ou r\u00e9sultats, \u00e0 r\u00e9aliser dans un d\u00e9lai d\u00e9termin\u00e9 et \u00e0 un prix convenu. Vous comptez sur la soci\u00e9t\u00e9 pour agir, pas sur un individu qui est pay\u00e9 par la soci\u00e9t\u00e9. Par cons\u00e9quent, cela ne devrait pas avoir d\u2019importance :  <\/p>\n<ul>\n<li>Qui effectue r\u00e9ellement le travail<\/li>\n<li>Quelles heures le travail est effectu\u00e9<\/li>\n<li>Combien d\u2019heures \u00e7a prend pour compl\u00e9ter le projet<\/li>\n<li>Si la soci\u00e9t\u00e9 offre aussi des services similaires \u00e0 vos concurrents en m\u00eame temps<\/li>\n<\/ul>\n<p>En revanche, lorsque vous engagez une personne, vous pouvez vous attendre \u00e0 ce qu\u2019elle :<\/p>\n<ul>\n<li>Ex\u00e9cutez personnellement le travail<\/li>\n<li>Ne pas embaucher un subordonn\u00e9<\/li>\n<li>\u00catre pay\u00e9 pour le temps travaill\u00e9 plut\u00f4t que pour un travail termin\u00e9<\/li>\n<li>Remboursez-les pour les d\u00e9penses<\/li>\n<li>Suis ton horaire quotidien pendant des heures<\/li>\n<li>Changer d\u2019activit\u00e9s pour r\u00e9pondre aux besoins quotidiens<\/li>\n<li>Ne pas travailler pour vos concurrents<\/li>\n<\/ul>\n<p>Comme vous pouvez le voir, la conformit\u00e9 des travailleurs ind\u00e9pendants devient plus complexe lorsqu\u2019on <a title=\"Synergy Vendor Qualification\" href=\"http:\/\/newco.synergyservicescorp.net\/clientsolutions\/vendor-qualification\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00e9value une situation avec un fournisseur d\u2019affaires <\/a>.
