Dans cet esprit, nous portons \u00e0 votre attention un changement l\u00e9gislatif aux \u00c9tats-Unis \u2014 la r\u00e8gle finale de la Federal Trade Commission (FTC) interdisant les clauses de non-concurrence \u00e0 l\u2019\u00e9chelle nationale. Ce changement pourrait avoir des r\u00e9percussions importantes sur vos op\u00e9rations commerciales et vos strat\u00e9gies de talent.    <\/p>\n\n<h3 class=\"wp-block-heading\">Comprendre la l\u00e9gislation  <\/h3>\n\n<p>Le 23 avril 2024, la FTC a annonc\u00e9 une r\u00e8gle finale interdisant aux employeurs d\u2019imposer des ententes de non-concurrence \u00e0 leurs travailleurs \u00e0 travers les \u00c9tats-Unis. Cette interdiction g\u00e9n\u00e9ralis\u00e9e vise \u00e0 promouvoir une concurrence \u00e9quitable, \u00e0 prot\u00e9ger la mobilit\u00e9 des travailleurs, \u00e0 stimuler l\u2019innovation et \u00e0 favoriser la cr\u00e9ation de nouvelles entreprises.   <\/p>\n\n<p><strong>Dispositions cl\u00e9s :<\/strong> <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Les clauses de non-concurrence existantes pour la plupart des travailleurs ne seront plus ex\u00e9cutoires apr\u00e8s l\u2019entr\u00e9e en vigueur de la r\u00e8gle.  <\/li>\n\n\n\n<li>Une exception limit\u00e9e permet aux non-concurrence des cadres sup\u00e9rieurs d\u00e9finis de mani\u00e8re \u00e9troite (moins de 0,75% des travailleurs) de rester valides.  <\/li>\n\n\n\n<li>Les employeurs n\u2019ont pas le droit de conclure de nouveaux accords de non-concurrence ou de tenter de faire respecter ceux existants pour la plupart des travailleurs.  <\/li>\n\n\n\n<li>Un avis doit \u00eatre donn\u00e9 \u00e0 tous les travailleurs actuels li\u00e9s par des clauses de non-concurrence non ex\u00e9cutoires.  <\/li>\n\n\n\n<li>La d\u00e9finition du travailleur est tr\u00e8s large, englobant non seulement les employ\u00e9s, mais aussi les travailleurs autonomes.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Ce que cela signifie pour vous  <\/h3>\n\n<p>L\u2019interdiction de non-concurrence pourrait avoir un impact significatif sur votre capacit\u00e9 \u00e0 retenir les talents. Cependant, elle offre aussi des occasions d\u2019attirer des travailleurs qualifi\u00e9s auparavant li\u00e9s par de tels accords.   <\/p>\n\n<p>Les entreprises devront examiner tous les accords de non-concurrence existants et donner un avis appropri\u00e9 aux travailleurs concern\u00e9s concernant les changements en mati\u00e8re d\u2019applicabilit\u00e9. De plus, votre organisation doit s\u2019abstenir d\u2019imposer de nouvelles clauses de non-concurrence \u00e0 la plupart des employ\u00e9s.   <\/p>\n\n<p>Bien que l\u2019interdiction de non-concurrence de la FTC ait d\u00e9j\u00e0 fait face \u00e0 des d\u00e9fis juridiques et que sa viabilit\u00e9 \u00e0 long terme soit incertaine, elle repr\u00e9sente une tendance plus large \u00e0 restreindre de tels accords. Au moins cinq \u00c9tats ont d\u00e9j\u00e0 mis en place des restrictions similaires, et d\u2019autres devraient suivre le mouvement \u00e0 l\u2019avenir.   <\/p>\n\n<p>\u00c0 court terme, cette r\u00e8gle pourrait avoir un impact significatif sur votre capacit\u00e9 \u00e0 retenir les talents gr\u00e2ce aux ententes de non-concurrence existantes.
