Dans cet esprit, nous portons \u00e0 votre attention une r\u00e9cente mise \u00e0 jour l\u00e9gislative, la r\u00e8gle finale du d\u00e9partement du Travail des \u00c9tats-Unis sur les exemptions d\u2019heures suppl\u00e9mentaires, qui pourrait avoir des implications importantes pour vos op\u00e9rations commerciales.   <\/p>\n\n<h3 class=\"wp-block-heading\">Comprendre la l\u00e9gislation  <\/h3>\n\n<p>Le d\u00e9partement du Travail des \u00c9tats-Unis a publi\u00e9 une r\u00e8gle finale le 23 avril 2024 pour relever les seuils salariaux pour certaines exemptions d\u2019heures suppl\u00e9mentaires en vertu de la loi f\u00e9d\u00e9rale Fair Labor Standards Act (FLSA). La r\u00e8gle vise \u00e0 s\u2019assurer que les employ\u00e9s gagnant moins de niveaux de salaire sp\u00e9cifi\u00e9s soient admissibles \u00e0 une r\u00e9mun\u00e9ration d\u2019heures suppl\u00e9mentaires lorsqu\u2019ils travaillent plus de 40 heures par semaine ou selon les exigences de l\u2019\u00c9tat. <\/p>\n\n<p><strong>Dispositions cl\u00e9s :<\/strong> <\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u00c0 compter <strong>du 1er juillet 2024<\/strong>, le seuil salarial pour les employ\u00e9s ex\u00e9cutifs, administratifs et professionnels passera \u00e0 43 888 $ par ann\u00e9e, et le seuil des employ\u00e9s hautement r\u00e9mun\u00e9r\u00e9s passera \u00e0 132 964 $ par ann\u00e9e.  <\/li>\n\n\n\n<li>Le <strong>1er janvier 2025<\/strong>, les seuils augmenteront encore \u00e0 58 656 $ par ann\u00e9e pour les employ\u00e9s de direction, administratifs et professionnels, et \u00e0 151 164 $ par ann\u00e9e pour les employ\u00e9s hautement r\u00e9mun\u00e9r\u00e9s.  <\/li>\n\n\n\n<li>\u00c0 partir du <strong>1er juillet 2027<\/strong>, et tous les trois ans par la suite, les seuils salariaux seront automatiquement mis \u00e0 jour.  <\/li>\n<\/ul>\n\n<p>La r\u00e8gle ne modifie pas les tests de t\u00e2ches pour les exemptions d\u2019heures suppl\u00e9mentaires; Il ne fait que mettre \u00e0 jour les exigences salariales. Notez qu\u2019il y a de fortes chances que cette d\u00e9cision soit contest\u00e9e et puisse \u00eatre annul\u00e9e en cas de changement d\u2019administration en 2025.   <\/p>\n\n<h3 class=\"wp-block-heading\">Ce que cela signifie pour vous  <\/h3>\n\n<p>Les employeurs pourraient devoir reclasser certains employ\u00e9s comme non exempt\u00e9s et leur verser des heures suppl\u00e9mentaires si leur salaire descend sous les nouveaux seuils.
