Dans cet esprit, nous souhaitons attirer votre attention sur une r\u00e9cente mise \u00e0 jour l\u00e9gislative concernant la norme officielle mexicaine NOM-037-STPS-2023 T\u00e9l\u00e9travail &#8211; Conditions de s\u00e9curit\u00e9 et sant\u00e9 au travail (NOM-037), qui a des implications importantes sur la solution EOR Mexique, notamment en ce qui concerne l\u2019environnement de travail qui doit \u00eatre offert aux employ\u00e9s dans le pays.   <\/p>\n\n<h3 class=\"wp-block-heading\">Comprendre la l\u00e9gislation  <\/h3>\n\n<p>La NOM-037 \u00e9tablit officiellement la distinction entre l\u2019environnement de travail de l\u2019entreprise o\u00f9 le personnel d\u00e9veloppe ses activit\u00e9s : sur place, o\u00f9 les activit\u00e9s se d\u00e9roulent en personne, et le lieu de travail \u00e0 distance. Cette distinction est importante car elle fixe les obligations et exigences concernant les conditions de sant\u00e9 et de s\u00e9curit\u00e9, qui doivent \u00eatre offertes au personnel conform\u00e9ment \u00e0 son r\u00e9gime de travail. Les principaux objectifs de l\u2019adoption de la NOM-037 sont de r\u00e9glementer et d\u2019am\u00e9liorer les conditions de s\u00e9curit\u00e9 et de sant\u00e9 au travail, en priorisant le bien-\u00eatre du personnel.    <\/p>\n\n<p><strong>Dispositions cl\u00e9s :<\/strong> <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Les employeurs doivent \u00e9tablir une politique \u00e9crite de t\u00e9l\u00e9travail qui r\u00e9pond \u00e0 certaines exigences sp\u00e9cifiques de contenu. Une telle politique doit, entre autres, :   \n<ul class=\"wp-block-list\">\n<li>\u00c9tablir des m\u00e9canismes de communication pour \u00e9viter l\u2019isolement des t\u00e9l\u00e9travailleurs; et  <\/li>\n\n\n\n<li>\u00c9tablissez des horaires de travail incluant le droit de se reposer et de se d\u00e9connecter.  <\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Les employeurs ayant du personnel de t\u00e9l\u00e9travail doivent disposer d\u2019une liste des t\u00e9l\u00e9travailleurs et des lieux de travail convenus, et garantir la confidentialit\u00e9 de cette liste.  <\/li>\n\n\n\n<li>Les t\u00e9l\u00e9travailleurs doivent recevoir une formation sur les risques professionnels, y compris les risques ergonomiques et psychosociaux, ainsi que sur les conditions de sant\u00e9 et de s\u00e9curit\u00e9.  <\/li>\n\n\n\n<li>L\u2019employeur doit disposer de listes de v\u00e9rification initiales et p\u00e9riodiques sur les conditions de s\u00e9curit\u00e9 et de sant\u00e9 pour le t\u00e9l\u00e9travail, qui doivent \u00eatre utilis\u00e9es afin de v\u00e9rifier que les lieux de travail des t\u00e9l\u00e9travailleurs respectent les conditions appropri\u00e9es de sant\u00e9 et s\u00e9curit\u00e9.  <\/li>\n\n\n\n<li>Une formation sur les risques professionnels (y compris les risques ergonomiques et psychosociaux, ainsi que sur les conditions de sant\u00e9 et s\u00e9curit\u00e9) doit \u00eatre dispens\u00e9e au personnel au d\u00e9but du contrat de travail.  <\/li>\n\n\n\n<li>Pour satisfaire \u00e0 certaines exigences, un comit\u00e9 employeur-employ\u00e9 pour la sant\u00e9 et la s\u00e9curit\u00e9 peut \u00eatre \u00e9tabli, et les documents de conformit\u00e9 doivent \u00eatre partag\u00e9s avec la commission.  <\/li>\n\n\n\n<li>Les examens m\u00e9dicaux sont applicables et doivent \u00eatre effectu\u00e9s au d\u00e9but de la relation d\u2019emploi.  <\/li>\n\n\n\n<li>L\u2019employeur doit \u00e9tablir des m\u00e9canismes pour g\u00e9rer la violence conjugale.  <\/li>\n\n\n\n<li>La nouvelle norme \u00e9tablit \u00e9galement certaines obligations applicables au personnel, notamment le respect de la politique de t\u00e9l\u00e9travail, le maintien de ses outils de travail en bon \u00e9tat, le respect des dispositions relatives \u00e0 la sant\u00e9 et s\u00e9curit\u00e9 au travail, le respect des politiques et m\u00e9canismes de protection des donn\u00e9es et de l\u2019information, ainsi que l\u2019information des employeurs concernant les changements d\u2019adresse, entre autres.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Ce que cela signifie pour vous<\/h3>\n\n<p>Les entreprises qui placent du personnel au Mexique devront se conformer aux nouvelles obligations et exigences introduites par la NOM-037, telles que :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Ajuster les contrats de travail avec des clauses sp\u00e9cifiques concernant les t\u00e9l\u00e9travailleurs nouveaux et existants.  <\/li>\n\n\n\n<li>Mettre \u00e0 jour la politique de t\u00e9l\u00e9travail en respectant les nouvelles exigences r\u00e9glementaires.  <\/li>\n\n\n\n<li>Effectuer p\u00e9riodiquement des listes de v\u00e9rification en sant\u00e9 et s\u00e9curit\u00e9 et fournir des installations ergonomiques. L\u2019employeur doit s\u2019assurer que le t\u00e9l\u00e9travailleur dispose d\u2019une chaise ergonomique, ainsi que de tout le mat\u00e9riel n\u00e9cessaire \u00e0 l\u2019ex\u00e9cution de ses fonctions. People2.0 analysera la configuration du t\u00e9l\u00e9travail et, si ce n\u2019est pas appropri\u00e9, People2.0 la fournira et informera\/facturera le client pour ce co\u00fbt.    <\/li>\n\n\n\n<li>\u00c9tablir des m\u00e9canismes pour traiter les cas de violence sexuelle ou de genre li\u00e9s au personnel.  <\/li>\n\n\n\n<li>Mettre en place des examens m\u00e9dicaux \u00e0 effectuer au d\u00e9but de la relation d\u2019emploi, en r\u00e8gle g\u00e9n\u00e9rale.  <\/li>\n\n\n\n<li>Offrir une formation sur les risques professionnels (y compris les risques ergonomiques et psychosociaux, ainsi que sur les conditions de sant\u00e9 et s\u00e9curit\u00e9) au d\u00e9but des affectations.  <\/li>\n<\/ul>\n\n<p>De plus, il est important que les clients et les clients finaux collaborent pour garantir que tout le personnel b\u00e9n\u00e9ficie d\u2019un environnement de travail sain et s\u00e9curitaire, conform\u00e9ment aux instructions de People2.0.  <\/p>\n\n<p>People2.0 offre des conseils et du soutien tout au long de la mise en place de l\u2019emploi dans notre structure corporative.
