De nouvelles exigences concernant les offres d\u2019emploi et la tenue des dossiers d\u2019emploi seront d\u00e9ploy\u00e9es en deux phases, avec des dates d\u2019effet confirm\u00e9es maintenant disponibles.   <\/p>\n\n<p>Ces changements auront un impact sur les employeurs comptant 25 employ\u00e9s ou plus et repr\u00e9sentent le plus r\u00e9cent effort de l\u2019Ontario pour accro\u00eetre la transparence et l\u2019\u00e9quit\u00e9 en milieu de travail.  <\/p>\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-30497ceec10bead3a6f650b4fc27f294\" style=\"color:#056892\">Chronologie cl\u00e9 de mise en \u0153uvre  <\/h3>\n\n<p class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-efc59c62ba0d4ec98295aea20f403536\">Les nouvelles exigences de l\u2019ESA entreront en vigueur en deux phases :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>1er juillet 2025 :<\/strong> Exigences d\u2019information d\u2019emploi pour les nouvelles recrues (cette mise \u00e0 jour ne s\u2019applique pas aux travailleurs assign\u00e9s et donc aucune mise \u00e0 jour des notifications g\u00e9n\u00e9r\u00e9es par le syst\u00e8me n\u2019est requise)  <\/li>\n\n\n\n<li><strong>1er janvier 2026 :<\/strong> Exigences pour l\u2019offre d\u2019emploi publique  <\/li>\n<\/ul>\n\n<p>Les deux types de changements s\u2019appliquent uniquement aux employeurs comptant 25 employ\u00e9s ou plus.  <\/p>\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-89c2fa11fe5ef9262d976042f17dd3f2\" style=\"color:#056892\">Exigences pour l\u2019offre d\u2019emploi (en vigueur le 1er janvier 2026)<\/h3>\n\n<p>La Loi Working for Workers Four de 2024 et la Loi Working for Workers Five de 2024 ont introduit de nouvelles exigences compl\u00e8tes pour les offres d\u2019emploi publiquement affich\u00e9es. Les r\u00e8glements r\u00e9cents ont clarifi\u00e9 la port\u00e9e et les d\u00e9tails de ces obligations.   <\/p>\n\n<h4 class=\"wp-block-heading\"><em><em>Qu\u2019est-ce qui constitue une offre d\u2019emploi publique  <\/em><\/em><\/h4>\n\n<p>Une offre d\u2019emploi publique inclut toute offre d\u2019emploi externe qu\u2019un employeur ou une personne agissant en son nom annonce au grand public de quelque mani\u00e8re que ce soit.  <\/p>\n\n<p><strong>Les exceptions importantes incluent :<\/strong> <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Campagnes de recrutement g\u00e9n\u00e9rales qui ne font pas la promotion d\u2019un poste pr\u00e9cis  <\/li>\n\n\n\n<li>Affiches g\u00e9n\u00e9rales de recherche d\u2019aide sans d\u00e9tails pr\u00e9cis sur le poste  <\/li>\n\n\n\n<li>Offres r\u00e9serv\u00e9es aux employ\u00e9s existants  <\/li>\n\n\n\n<li>Postes o\u00f9 le travail est effectu\u00e9 \u00e0 l\u2019ext\u00e9rieur de l\u2019Ontario (avec des conditions sp\u00e9cifiques)  <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><em><em>Nouvelles exigences pour les offres d\u2019emploi  <\/em><\/em><\/h4>\n\n<p class=\"has-text-color has-link-color wp-elements-1d6eed27b557d25888564d84c98ee622\" style=\"color:#037f9a\"><strong><em>Divulgation de la fourchette de r\u00e9mun\u00e9ration  <\/em><\/strong><\/p>\n\n<p>Les employeurs doivent inclure les informations sur la r\u00e9mun\u00e9ration attendue ou la fourchette de r\u00e9mun\u00e9ration dans les offres d\u2019emploi. D\u00e9tails cl\u00e9s :   <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Si vous fournissez une fourchette, la diff\u00e9rence entre les taux sup\u00e9rieur et inf\u00e9rieur ne peut pas d\u00e9passer 50 000 $ (exemple : 70 000 $ \u00e0 120 000 $)  <\/li>\n\n\n\n<li>La r\u00e9mun\u00e9ration inclut ce que l\u2019ESA d\u00e9finit comme des \u00ab salaires \u00bb  <\/li>\n\n\n\n<li>Cette exigence ne s\u2019applique pas aux postes dont la r\u00e9mun\u00e9ration annuelle attendue d\u00e9passe 200 000 $  <\/li>\n<\/ul>\n\n<p class=\"has-text-color has-link-color wp-elements-4ef95112a454f394f972fe94a387da92\" style=\"color:#037f9a\"><strong><em>Restrictions sur l\u2019exp\u00e9rience canadienne  <\/em><\/strong><\/p>\n\n<p>Les employeurs ne peuvent pas inclure d\u2019exigences li\u00e9es \u00e0 l\u2019exp\u00e9rience canadienne dans les offres d\u2019emploi ou les formulaires de candidature.  <\/p>\n\n<p class=\"has-text-color has-link-color wp-elements-2d6e7f74ecb6b9a1258abb2d84c48a18\" style=\"color:#037f9a\"><strong><em>Divulgation de l\u2019intelligence artificielle  <\/em><\/strong><\/p>\n\n<p>Les employeurs utilisant l\u2019intelligence artificielle pour filtrer, \u00e9valuer ou s\u00e9lectionner les candidats doivent divulguer cet usage dans l\u2019offre d\u2019emploi. Le r\u00e8glement d\u00e9finit l\u2019intelligence artificielle comme \u00ab un syst\u00e8me bas\u00e9 sur des machines qui, pour des objectifs explicites ou implicites, d\u00e9duit des donn\u00e9es qu\u2019il re\u00e7oit pour g\u00e9n\u00e9rer des sorties telles que des pr\u00e9dictions, du contenu, des recommandations ou des d\u00e9cisions pouvant influencer les environnements physiques ou virtuels. \u00bb   <\/p>\n\n<p class=\"has-text-color has-link-color wp-elements-75bbc4c4421fd73219451148707ec2c8\" style=\"color:#037f9a\"><strong><em>Statut vacant existant  <\/em><\/strong><\/p>\n\n<p>Les offres d\u2019emploi doivent inclure une d\u00e9claration indiquant si l\u2019offre correspond \u00e0 un poste d\u00e9j\u00e0 vacant ou non.  <\/p>\n\n<p class=\"has-text-color has-link-color wp-elements-ced45eb09713bb17053c136e0e0d9e88\" style=\"color:#037f9a\"><strong><em>Communication post-entrevue  <\/em><\/strong><\/p>\n\n<p>Si un employeur passe une entrevue avec un candidat, il doit l\u2019informer dans les 45 jours suivant la derni\u00e8re entrevue si une d\u00e9cision d\u2019embauche a \u00e9t\u00e9 prise concernant l\u2019offre d\u2019emploi.  <\/p>\n\n<p class=\"has-text-color has-link-color wp-elements-d6407cadd950df3c7bb080d435186504\" style=\"color:#037f9a\"><strong><em>Exigences de conservation des dossiers  <\/em><\/strong><\/p>\n\n<p>Les employeurs doivent conserver les offres d\u2019emploi, les formulaires de candidature associ\u00e9s et les informations post-entrevue fournis aux candidats pendant trois ans.  <\/p>\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-dab2f4176b60499a09861e0183ae10a9\" style=\"color:#056892\">Informations sur l\u2019emploi pour les nouvelles recrues (en vigueur le 1er juillet 2025)  <\/h3>\n\n<p>\u00c0 partir du 1er juillet 2025, les employeurs doivent fournir aux nouveaux employ\u00e9s des informations sp\u00e9cifiques par \u00e9crit avant leur premier jour de travail, ou d\u00e8s que raisonnablement possible si leur fournir \u00e0 l\u2019avance n\u2019est pas r\u00e9alisable.  <\/p>\n\n<h4 class=\"wp-block-heading\"><em>Exemptions importantes  <\/em><\/h4>\n\n<p>Ces exigences d\u2019information sur l\u2019emploi ne s\u2019appliquent <strong>pas<\/strong> \u00e0 :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Employeurs comptant moins de 25 employ\u00e9s lors de leur premier jour de travail  <\/li>\n\n\n\n<li>Employ\u00e9s assign\u00e9s (ceux employ\u00e9s par des agences d\u2019aide temporaire pour les affectations temporaires de clients)  <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><em>Informations requises  <\/em><\/h4>\n\n<p>Les employeurs doivent fournir :  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Le nom l\u00e9gal de l\u2019employeur et tout autre nom d\u2019exploitation ou d\u2019entreprise  <\/li>\n\n\n\n<li>Informations de contact incluant adresse, num\u00e9ro de t\u00e9l\u00e9phone et noms de contact  <\/li>\n\n\n\n<li>Une description g\u00e9n\u00e9rale de l\u2019endroit o\u00f9 l\u2019employ\u00e9 effectuera initialement son travail  <\/li>\n\n\n\n<li>Le salaire horaire de d\u00e9part, les autres taux de salaire ou la structure de commission de l\u2019employ\u00e9  <\/li>\n\n\n\n<li>La p\u00e9riode de paie \u00e9tablie et la date de paie  <\/li>\n\n\n\n<li>Une description g\u00e9n\u00e9rale des heures de travail initiales pr\u00e9vues par l\u2019employ\u00e9  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-ccb772666361db6204e1135051690bc1\" style=\"color:#056892\">Prochaines \u00e9tapes pour les employeurs<\/h3>\n\n<p>Ces nouvelles exigences repr\u00e9sentent des changements importants dans le paysage de l\u2019emploi en Ontario. Les employeurs comptant 25 employ\u00e9s ou plus devraient commencer \u00e0 se pr\u00e9parer d\u00e8s maintenant en :   <\/p>\n\n<ul class=\"wp-block-list\">\n<li>R\u00e9vision des pratiques et mod\u00e8les actuels d\u2019offres d\u2019emploi  <\/li>\n\n\n\n<li>\u00c9tablir des politiques et proc\u00e9dures pour la fourchette de r\u00e9mun\u00e9ration  <\/li>\n\n\n\n<li>Mettre \u00e0 jour les processus de recrutement pour s\u2019adapter aux nouvelles exigences de divulgation  <\/li>\n\n\n\n<li>Mise en \u0153uvre de syst\u00e8mes de suivi et de conservation des dossiers requis  <\/li>\n\n\n\n<li>Former les \u00e9quipes RH et les gestionnaires d\u2019embauche sur les nouvelles obligations  <\/li>\n<\/ul>\n\n<p>La l\u00e9gislation sur les normes d\u2019emploi continue d\u2019\u00e9voluer alors que les gouvernements r\u00e9agissent aux dynamiques changeantes du milieu de travail.
